1. Purpose

The Agency retains A1A Auto Booting, LLC (“Contractor”) to provide parking enforcement and vehicle immobilization (“booting”) services for vehicles parked in violation of applicable ordinances, municipal codes, posted parking regulations, or other rules authorized by the Agency.

2. Term

Either party may terminate this Agreement upon the written-notice period entered above unless otherwise required by law.

3. Scope of Services

A1A Auto Booting shall:

  • Patrol designated municipal parking facilities.
  • Enforce parking regulations authorized by the Agency.
  • Install vehicle immobilization devices on qualifying vehicles.
  • Maintain electronic records of every enforcement action.
  • Photograph each violation before and after boot installation.
  • Provide customer service for motorists.
  • Remove boots promptly after payment or authorization.
  • Maintain a 24-hour dispatch line.
  • Coordinate with law enforcement when required.
  • Submit monthly enforcement reports.

Contractor agrees to:

  • Maintain all required business licenses.
  • Maintain commercial liability insurance.
  • Maintain workers’ compensation coverage if required.
  • Ensure employees are properly trained.
  • Wear professional uniforms.
  • Use marked enforcement vehicles.
  • Maintain GPS activity logs.
  • Protect confidential information.

7. Agency Responsibilities

Agency shall:

  • Identify authorized enforcement locations.
  • Provide maps and parking regulations.
  • Maintain required signage.
  • Notify Contractor of ordinance changes.
  • Provide contact information for designated officials.

8. Vehicle Documentation

For every immobilized vehicle Contractor shall record:

  • Date
  • Time
  • GPS location
  • License plate
  • Vehicle description
  • Photographs
  • Officer identification
  • Reason for enforcement

9. Customer Service

Contractor shall:

  • Answer calls 24 hours per day.
  • Accept approved payment methods.
  • Remove boots within the response time required by law or contract after payment and verification.
  • Maintain courteous customer service.

10. Reporting

Monthly reports shall include:

  • Patrol hours
  • Number of boots installed
  • Number removed
  • Revenue collected
  • Violations by location
  • Average response times
  • Customer complaints
  • Incident reports

11. Insurance

Contractor shall maintain:

  • Commercial General Liability
  • Automobile Liability
  • Workers’ Compensation (if applicable)
  • Any additional coverage required by the Agency

Certificates of Insurance shall be provided upon request.

12. Indemnification

Each party shall be responsible for its own negligent acts or omissions to the extent permitted by applicable law. Nothing in this Agreement shall be construed as a waiver of any governmental immunities or legal protections available to the Agency.

Contractor agrees to comply with:

  • Florida Statutes
  • Applicable municipal ordinances
  • Public records requirements, if applicable
  • OSHA regulations
  • Equal employment laws
  • Agency policies
Public-records clause required before execution.

Florida public-agency service contracts may require specific public-records language and the agency custodian’s contact information. Agency counsel should insert the approved clause applicable to this procurement.

14. Default

Material breach includes:

  • Failure to maintain insurance
  • Fraud
  • Failure to perform services
  • Repeated customer complaints substantiated by the Agency
  • Violation of applicable law

15. Dispute Resolution

The parties shall first attempt to resolve disputes through good-faith negotiations. Any remaining disputes shall be handled in the courts of the State of Florida unless another dispute resolution process is required by law or the procurement documents.

16. Entire Agreement

This document constitutes the entire Agreement between the parties and supersedes prior discussions relating to the services described herein.
